Terms of Service

01Parties & acceptance

These Terms of Service (the “Terms”) are a binding agreement between you (“you”) and Importify Limited, a company incorporated under the laws of Hong Kong Special Administrative Region with its registered office at Unit 1603, 16th Floor, The L. Plaza, 367–375 Queen’s Road Central, Sheung Wan, Hong Kong SAR (“Importify,” “we,” “us”).

By accessing domcheck.app, the /app/ dashboard, or any of our APIs (the “Service”), or by clicking “Sign in”, “Subscribe”, or “Pay”, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy.

02Eligibility

You may use the Service only if you are at least 18 years old (or the age of legal majority in your jurisdiction, whichever is higher) and have the legal capacity to enter into a binding contract. If you are using the Service on behalf of a company or other entity, you represent that you have authority to bind that entity to these Terms, and “you” refers to that entity.

You must not use the Service if you are barred from doing so under the laws of Hong Kong, your country of residence, or any jurisdiction subject to comprehensive sanctions administered by the United States, the United Kingdom, the European Union, or the United Nations.

03The Service

domcheck.app is an AI-assisted tool that helps you find buildable domain names. You submit a short brief describing what you are building; we use OpenAI to generate candidate domain names; we verify each candidate’s registration status using public DNS and RDAP data; and we display estimated registration prices using data from Namecheap.

The Service is a research tool. We do not register, broker, sell, or hold domain names. To register a domain, you must complete the purchase through a third-party registrar (such as Namecheap), under that registrar’s own terms.

04Your account

To use most features of the Service you must sign in with a Google account. By signing in you authorise us to receive the account email, display name, and Google account ID, as described in the Privacy Policy.

• You are responsible for the security of your Google account and for all activity that occurs through your domcheck account;
• You must use accurate information, must not impersonate another person, and must not create or operate multiple accounts to evade plan limits, free-tier caps, or enforcement actions;
• You agree to notify us at domcheck.app@gmail.com if you suspect any unauthorised use of your account.

05Plans & pricing

The Service is offered under the following plans, in United States dollars:

Daily counters reset at 00:00 UTC each day. We may adjust prices, plan structure, or features from time to time; changes apply prospectively and do not affect plans you have already purchased.

“Lifetime” means for as long as the Service is offered by Importify. We do not guarantee that the Service will be available indefinitely; if we discontinue the Service entirely, we will give you reasonable advance notice and will not pro-rate or refund Lifetime purchases except where required by applicable law.

06Payments & taxes

Payments for paid plans are processed by PayPro Global, Inc. as our authorised reseller and merchant of record. When you purchase a plan you are entering into a separate transaction with PayPro on its own terms, in addition to these Terms.

All prices are quoted in USD and are exclusive of any value-added tax, goods-and-services tax, sales tax, or similar transaction tax. PayPro will calculate and add any applicable tax at checkout based on the address and country you provide. You are responsible for any other taxes, duties, or charges arising from your use of the Service in your jurisdiction.

If your payment is declined, charged back, or reversed for any reason, we may immediately suspend your plan and revert your account to the Free plan until the issue is resolved.

07Refund Policy — no refunds

Limited exceptions

The “no refunds” rule above is subject only to the following:

• Duplicate or unauthorised charges. If you were charged twice for the same plan, or if a charge was made to your account without your authorisation, contact domcheck.app@gmail.com within 14 days of the charge and we will investigate and reverse the erroneous portion.
• Statutory rights. Nothing in this section limits or excludes any non-waivable consumer right under your local law.
• Service unavailability. If we permanently terminate the Service or your account for reasons other than your breach of these Terms while you have a then-current Daily or Monthly plan, we may, at our discretion, refund the unused pro-rated portion.

Refund requests outside these exceptions will be declined. Plans are also non-transferable: you cannot reassign a plan to a different account, even if the original account is closed.

08Acceptable Use Policy

You may use the Service only for lawful purposes and in line with these Terms. You agree that you will not:

• Access the Service or any API endpoint by automated means (bots, crawlers, headless browsers, scripts), or attempt to circumvent any rate limit, search cap, or paywall;
• Create multiple accounts to bypass the free-tier limit, daily cap, or any enforcement action against your account;
• Resell, redistribute, sublicense, or expose the Service or its outputs as part of another product or service without our prior written agreement;
• Use the Service to identify or pursue domain names that infringe third-party trademarks (including for the purpose of cybersquatting or typosquatting under the U.S. ACPA, the UDRP, or comparable laws);
• Use the Service to facilitate fraud, phishing, malware distribution, harassment, or any unlawful activity;
• Submit briefs that contain another person’s personal data without their consent, or that contain classified, export-controlled, or sanctioned-party information;
• Probe, scan, or test the vulnerability of the Service or its infrastructure, or breach or attempt to breach any security or authentication measure;
• Interfere with, disrupt, or impose an unreasonable load on the Service or its underlying providers (Google, Supabase, OpenAI, Namecheap, PayPro, DigitalOcean/Cloudways);
• Reverse-engineer, decompile, or attempt to extract the underlying source code of the Service, except to the extent this restriction is prohibited by law;
• Use the Service in any way that violates the terms of service of any of the third-party providers listed above, or the laws of Hong Kong or your jurisdiction.

We may investigate suspected violations and take any action we consider appropriate, including warning you, removing content, suspending or terminating your account, reversing fraudulent transactions, and reporting unlawful activity to law-enforcement authorities.

09AI-generated content & availability

The candidate domain names shown by the Service are generated by an artificial-intelligence model in response to your brief. AI output is probabilistic and is provided for informational purposes only.

• We do not guarantee that any generated name is original, distinctive, available for trademark registration in any jurisdiction, non-infringing of third-party rights, or suitable for your business;
• It is your sole responsibility to perform appropriate trademark, search-engine, and due-diligence checks before adopting a name, registering a domain, or making any commercial commitment based on the Service;
• The availability and price information displayed is captured at the moment of lookup from DNS, RDAP, and Namecheap. Domain availability can change within seconds. We do not reserve, hold, or guarantee the registration of any name shown as “available”. The only way to secure a domain is to complete the registration with a registrar.

You will not hold us responsible if a domain becomes unavailable, increases in price, or is registered by a third party between your lookup and your attempted purchase.

10Intellectual property

The Service, including its software, design, copy, branding, structure, and aggregate data, is owned by Importify Limited and our licensors and is protected by copyright, trademark, and other intellectual-property laws. We grant you a personal, non-exclusive, non-transferable, revocable licence to access and use the Service for your own internal or personal use, subject to these Terms.

You retain ownership of the brief text you submit. By submitting it, you grant us a worldwide, royalty-free licence to process it for the purpose of operating the Service (including sending it to OpenAI for generation), and to retain it in your account history until you delete it. We do not use your briefs to train AI models.

You own your choice of domain names selected from the Service’s output; we make no ownership claim over names you decide to register.

11Third-party services

The Service relies on independent third-party providers. Your use of the Service is also subject to those providers’ terms and policies, including:

• Google — OAuth sign-in;
• Supabase — account database and authentication;
• OpenAI — AI generation of candidate names;
• Namecheap — domain availability and price data;
• PayPro Global — payment processing and tax handling;
• Cloudways / DigitalOcean — hosting.

We are not responsible for the acts, omissions, downtime, or content of these providers. If a provider changes its terms, pricing, or availability, we may need to adjust the Service accordingly.

14Indemnification

You agree to defend, indemnify, and hold harmless Importify Limited and its directors, officers, employees, and agents from and against any claim, demand, loss, liability, damage, cost, or expense (including reasonable legal fees) arising out of or related to: (i) your use of the Service; (ii) your breach of these Terms or the Acceptable Use Policy; (iii) your violation of any law or third-party right (including any trademark or other intellectual-property right) in connection with names you select, register, or use; or (iv) content you submit through the Service.

15Termination

You may stop using the Service at any time. You may delete your account from the dashboard’s Danger Zone; deletion is processed within 30 days, subject to the retention periods described in our Privacy Policy. Termination does not entitle you to a refund (see §7).

We may suspend or terminate your account, with or without notice, if we reasonably believe that:

• You have breached these Terms or the Acceptable Use Policy;
• Your payment has been reversed, charged back, or is suspected of fraud;
• Continued provision to you would expose us, our providers, or other users to legal or security risk;
• We are required to do so by law or by a request from a competent authority.

We may also terminate your account, or discontinue the Service entirely, on reasonable prior notice for any other reason. The sections of these Terms that by their nature should survive termination — including §7 (Refunds), §10 (IP), §12 (Warranties), §13 (Liability), §14 (Indemnification), §17 (Governing Law), and §18 (General) — will survive.

16Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date at the top of this page and, where required, notify you in the dashboard or by email at least 14 days before the change takes effect. Non-material changes (typo fixes, clarifications) take effect immediately.

If you continue to use the Service after a change takes effect, you accept the revised Terms. If you do not accept them, you must stop using the Service. No refund is due for such cessation.

17Governing law & disputes

These Terms, and any dispute or claim arising out of or in connection with them or their subject matter, are governed by the laws of the Hong Kong Special Administrative Region, without regard to its conflict-of-laws principles.

Any dispute, controversy, or claim arising out of or relating to these Terms, or the breach, termination, or invalidity thereof, will be referred to and finally resolved by arbitration administered by the Hong Kong International Arbitration Centre (HKIAC) under the HKIAC Administered Arbitration Rules in force when the notice of arbitration is submitted. The seat of arbitration is Hong Kong, the number of arbitrators is one, and the language of the arbitration is English.

Class-action waiver. To the extent permitted by law, you and Importify each agree that any dispute will be resolved on an individual basis and not as a class, collective, or representative action.

Nothing in this section prevents either party from seeking interim or injunctive relief in a court of competent jurisdiction to protect its intellectual-property rights or confidential information.

18General

• Entire agreement. These Terms, together with the Privacy Policy and any plan-specific terms presented at checkout, constitute the entire agreement between you and Importify regarding the Service.
• Severability. If any provision is held unenforceable, the remaining provisions will continue in full force, and the unenforceable provision will be modified to the minimum extent necessary to make it enforceable.
• No waiver. Our failure to enforce any right or provision is not a waiver of it.
• Assignment. You may not assign or transfer these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, reorganisation, or sale of all or substantially all of our assets.
• Force majeure. Neither party is liable for delays or failures caused by events beyond its reasonable control, including acts of government, natural disasters, war, civil unrest, internet outages, or failures of upstream providers.
• Notices to you may be given via the email address on your account or by an in-app notice. Notices to us must be sent to the address in §19.
• Language. These Terms are written in English. Any translation is provided for convenience only; in case of conflict, the English version controls.
